We are very happy to have your child as a student at Lady Evelyn Independent School. To maintain the high standard of education you and your child deserve, we have a simple set of conditions that form the agreement between you and the school. Please read them carefully to ensure that you and your child are happy with them. These Conditions form a legally binding agreement for the provision of educational services.

1. Introduction

This agreement sets out the terms and conditions upon which a place has been offered to your child. By accepting a place for your child as a student you agree to be bound by these terms and conditions. We have endeavoured to draft this document in clear language, free, where possible, from legal jargon. It is, however, legally binding on both Lady Evelyn Independent School (Lady Evelyn Limited of Room 7B, One Capital Place, 18 Luard Road, Wan Chai, Hong Kong.) and you. In this document, the term ‘parents’ is frequently used. Guardians are included within the meaning of that word.

2. Duration

This agreement will remain in force until your child concludes the end of Year 11 and all fees have been paid. If your child joins in Year 12 or 13 then the agreement remains in force until your child reaches the end of Year 13 and all fees have been paid in accordance with Condition 5 below.

3. Authority of the Headteacher

Parents authorise the Headteacher of Lady Evelyn Independent School or their nominated deputy to take such action as the Headteacher may consider being in the best interests of the student on a day-to-day basis.

4. Provision of Education

The Lady Evelyn Independent School will do all that is reasonable to provide an educational environment and teaching of a range, standard and quality which is suitable for each student.

5. Fees

The fees and other expenses payable and the timing of such fees are set out on the Lady Evelyn Independent School website.

The School makes every effort to hold fees stable for each academic year. However, the School reserves the right to increase fees at any time; any increase will be notified to you at least thirty (30) days before the increase takes effect. The liability to pay fees and all other expenses is the joint and several liabilities of the people who have signed the Conditions of Attendance.

A student whose fees have not been paid in full or in accordance with an agreed fee payment plan before the start of term may at any time be excluded from attending until full payment is made. Parents are liable to pay all costs, fees, disbursements and charges including legal fees and costs reasonably incurred by Lady Evelyn Independent School in the recovery of any unpaid fees regardless of the value of the claim.

The fees for additional subjects, electives and digital curriculum taken at any level are not eligible for a discount or refund if the student discontinues during the course.

The Academic Deposit is a deposit that is only refundable upon completion of an academic year, receipt of public exam results by the Headteacher, if applicable and payment of any outstanding fees.

6. Notice Period

Withdrawal from Lady Evelyn Independent School

A Withdrawal Notice must be given by email to su*****@la********.school. Notification to withdraw by telephone or any other means is not valid and we only accept an email from the registered parent or guardian. A Withdrawal Notice can only be retracted once, and there will be a charge equal to the Application Fee to reactivate the account. We will charge you a new Application Fee and Academic Deposit should the student wish to remain at the School after the second retraction. For students in the American Section, a Withdrawal Notice must be provided on or before the last day of the Quarter if on a Pay-As-You-Go Contract, or on or before the last day of the Academic Year if on an Annual Contract. For students in the British Section, a Withdrawal Notice must be provided on or before the last day of the Half-Term if on a Pay-As-You-Go Contract, or on or before the last day of the Academic Year if on an Annual Contract.

Withdrawal for Students on an Annual Contract

Your Annual Contract can be terminated with effect from the end of the last day of the Academic Year. A Withdrawal Notice can be given at any time up to this point via the registered email from the parent or guardian to su*****@la********.school. Notification to withdraw by telephone or any other means is not valid and we only accept an email from the registered parent or guardian. If the Withdrawal Notice results in a student leaving the School at any point prior to the end of an Academic Year, the full outstanding fees for that Academic Year will be due. A Withdrawal Notice for the student to leave at the end of an Academic Year must be received no later than the last day of timetabled classes for the School in that Academic Year. This is necessary to allow the School to plan its staffing and other resources.

To avoid ambiguity, if a Withdrawal Notice is not received by the last day of timetabled classes for the School in the Academic Year then the student will be deemed to be continuing for the following Academic Year and the fees and notice clause (and all other terms and conditions) for the relevant Academic Year will apply.
